Default Recording cops. Sure, but use common sense.

Recording police. Go for it, but not what you might expect.

This is still a hot topic and easier to do in 2013 than even ten years ago thanks to all the digital tech. But like anything in this world things aren't as black and white and some might think.

Idaho is a single consent state when it comes to being recorded. As an officer I consent to being recorded which means I and my fellow officers all carry digital recorders in our pockets. Many now have cameras in their hand microphones and ,of course, there are cameras in the patrol cars.

You can pretty much bet that if you have any interaction with an officer with my agency he or she will be recording you so feel free to record it yourself. Personally I once had somebody accuse me of lying to them, making threats and other things. They were making dark hints of lawsuits and what not. So I played my audio for them (my little voice told me to save that audio) and my lieutenant at the same time. The Lt. listened, thanked me and excused me, but asked the citizen to stay. He had me close the door to his office on the way out. that was the end of that situation.

Most of the time I just wave at the people with the cameras and smartphones. They usually wave back. Seems to throw them though. The worst thing I could do would be to act like a jackass. I've been on the television news before becasue I was doing my job (crime scenes, traffic crashes and so on). I have no desire to be on the news becasue I was a butt-head cop. Thank you.

One time I had a smartphone person walk right into the middle of a situation.A very dicey situation that was threatening to go south. I told them that they could keep recording, but if they try to interfere I would arrest them for Resist and Obstruct. I then ordered them to step back across the street for their safety and mine. She complied. I think she was hoping I would tell her to stop recording. Why? I was recording also.

Just a little FYI. We aren't all idiots or Nazi's.

Sounds to me like she fishing for a lawsuit against the city and a payout.

As far as official recordings by officers from their person and vehicles, I imagine maybe the new world order conspiracy theorists don't like the idea of such recordings being on the police's terms. Such people are suspicious of anything that doesn't validate their particular idea of the "truth", as you probably already know.

She probably was. After one highly charged (verbal) encounter with citizen a few years ago I informed her that I had recorded the conversation so please don't try to report a falsehood to my supervisors which she was infamous for. She was furious. Screamed that I am supposed to tell her that I'm recording. I just smiled and said "Not under Idaho law". She slammed the door in my face, but I got the last laugh. She never filed a complaint either.

It's the little things that make my job fun.

This is why I'm always suspicious of people posting "police brutality" clips after various protests. Because all they ever show is the officer subduing the subject, and never what caused it. Maybe they're afraid that if they show the protester being belligerent then it won't make the police look like a bunch of Neo-Nazi stormtroopers like they want it to.
