I figured they would've arrested him anyway. He was found wearing a business suit and a tactical vest (like the other shooters) and had a gun in his hand. I would've assumed that he was one of the shooters who had been wounded by the cops. And I'd think that being able to prevent a war between Russia and the United States would be worth the risk of being sent to a dungeon. And his close association with Makarov and the Ultranationalist movement probably would've made him even more credible, as he'd have less reason to lie.
