An MP5 isn't really an MP40 updated. The MP5 uses a roller delayed blow back operation. The MP40 is just a straight recoil operated SMG. The designs of both the MP5 and MP40 aren not similar at all, they don't even use the same type of stocks. The only thing the two have in common is the ammo they fired.
The MP5 was based off the G3 assault rifles, also made by HK which was reportedly taken from a design from Spain.
